ARTICLES OF H.I.S.

ARTICLE 1 (Coverage)

Under this agreement, H.I.S. Incorporated (hereby referred to as HIS), through its website http://hokkaido.his-j.com will be responsible for its sales site and the introduction of travel services. This agreement will cover the sole relationship between HIS and the user (under approval of this agreement, the user refers to the person using “H.I.S. Hokkaido Hotels”).

ARTICLE 2 (Objective)

“H.I.S. Hokkaido Hotels” will have the objective of offering and providing travel services to the user, and advertising these services.

ARTICLE 3 (Prohibition of Personal Information Disclosure)

HIS, through “H.I.S. Hokkaido Hotels” will not publish personal information entered by the user and used to directly contact that user. Such information includes the user’s registered address, telephone number and e-mail address.

ARTICLE 4 (Agreement of Terms)

Under this agreement, “H.I.S. Hokkaido Hotels” will coordinate the availability of its use. The user will comply with the terms and conditions of this agreement when using “H.I.S. Hokkaido Hotels”.

ARTICLE 5 (Agreement Revisions)

This agreement may be revised depending on HIS’ circumstances. Any revisions will be posted on the site of “H.I.S. Hokkaido Hotels”, and afterwards, in the case that the user does use its services, the user will be regarded as having agreed to these revisions.

ARTICLE 6 (User Eligibility)

Under this agreement, the user will be someone who will correctly make an application and comply with this office’s decision-making processes.

ARTICLE 7 (Cancellation of User Eligibility)

At HIS’ discretion, the user’s eligibility may be cancelled if the following has occurred:

Entering false information in the application
Improperly using information provided by “H.I.S. Hokkaido Hotels”
Breaking this agreement
HIS deciding that inappropriate use of “H.I.S. Hokkaido Hotels” has occurred

ARTICLE 8 (Connection to the Website)

When connecting to the website of “H.I.S. Hokkaido Hotels” to make use of its services, the user will be responsible for his own expenses. In the case where the transmission of service has been disrupted while in contact with the site, HIS will bear no responsibility.

ARTICLE 9 (Disclaimer Details and Responsibility for Offering Services)

When providing information on “H.I.S. Hokkaido Hotels”, HIS will not guarantee perfect accuracy or completeness. HIS will not bear responsibility for any damages incurred on the user or third parties due to such information.

ARTICLE 10 (Prohibition of Unauthorized Use of Information)

Any unauthorized use of information included on the images on the site of “H.I.S. Hokkaido Hotels” is prohibited. Therefore, any information on “H.I.S. Hokkaido Hotels” cannot be edited, reproduced or reprinted.

ARTICLE 11 (Copyright)

The layout, design and structure of “H.I.S. Hokkaido Hotels” are totally under the copyright of HIS Experience Japan Inc.

ARTICLE 12 (The Usage of User Information)

In principle, HIS will not provide registered user information to third parties without the consent of that user. However, this doesn’t apply in cases where HIS must defer to laws based on public institutions or public duty, or in the face of public institutions such as consumer centres. Furthermore, under the following cases, it may be necessary to provide registered user information to third parties without the user’s consent or payment. However, this is limited to information on individuals who cannot be specified.

Statistical analysis for improvement of “H.I.S. Hokkaido Hotels” operations, marketing and publishing of advertisements
Communication of relevant “H.I.S. Hokkaido Hotels” information
Publishing of secondary data from 1) to explain about “H.I.S. Hokkaido Hotels” and its services
“H.I.S. Hokkaido Hotels” reservation information (confirmation of number of vacant airplane seats as well as confirmation of the client during the trip)

HIS will take preventative measures against leaks in its management of any user information registered. If a leak has occurred due to illegal access or other means, HIS will assume full responsibility.

ARTICLE 13 (Prohibited Matters)

The user, when using “H.I.S. Hokkaido Hotels”, is prohibited from engaging in the following activities or contributing in such a way to cause such activities:

Indecent acts (anti-social activities or the advertising of such activities)
The encouragement of criminal acts (distribution of computer viruses, junk mail, spam mail, chain letters, pyramid schemes or any suggestion of them)
The violation of intellectual property rights (including but not limited to copyright, design rights, patents, utility model rights, trademarks, knowhow) of other users and third parties
The violation of property, trust, honour and privacy of other users and third parties
Activities that are against Japan and the law
Activities that are disadvantageous to other users and third parties
Activities that lead to the defamation of other users and third parties
Activities in which the sole purpose of the user or third parties is to advertise one’s own business (activities that have been specially approved by HIS are exempt)
Activities that are judged to have a bad influence on minors (including social activities of a sexual, religious or political nature)
Activities that interfere with the operation of “H.I.S. Hokkaido Hotels” or damage the trust of “H.I.S. Hokkaido Hotels”
Activities that breach this agreement
Other activities that are judged by HIS to be inappropriate
If any of the above activities have been committed, HIS will, without the consent of the corresponding user or third parties, halt such activities. HIS will also agree with the affected user that HIS will not bear responsibility.

ARTICLE 14 (The Cancellation of Service to Specified Users)

HIS may terminate the service of any specified user if it has been judged that HIS or any third parties were at risk of damage by the actions of the specified user.

ARTICLE 15 (Disclaimers)

HIS will decide on matters involving the operation of “H.I.S. Hokkaido Hotels” disclaimers in the following ways:

HIS, through “H.I.S. Hokkaido Hotels”, in terms of reliability and accuracy and waiving of security, consents to all people who have agreed to the terms of use to access this service. However, HIS doesn’t guarantee matters such as the contents of “H.I.S. Hokkaido Hotels”, certainty of offers, access results or security.
The use of “H.I.S. Hokkaido Hotels” is the user’s responsibility. It is the user’s own responsibility in terms of the information provided about HIS to users, including data storage, reproduction, and whether or not the user has the necessary legal rights when it comes to use by other users. Furthermore, it is also the user’s own responsibility to comply with legal obligations and laws concerning copyright, confidentiality, slander, quality assurance as well as export.
For the following reasons listed, service may be temporarily disrupted without advance warning to the user. In terms of any damage done because of service disruption, this office will bear no responsibility.
1. In the case of this office’s systems’ maintenance, examination and repair
2. In the case of inability to provide service due to fire or power outage
3. In the case of inability to provide service due to natural disasters
4. In cases where it is necessary for “H.I.S. Hokkaido Hotels” to temporarily stop service due to operational or technical concerns
HIS, as a rule, doesn’t engage in activities or communication between users. Should a dispute arise between users, it is to be resolved by the users involved. This office will bear no responsibility for this resolution.
HIS will also bear no responsibility for damages caused by any addition, change, disruption or termination of service.

ARTICLE 16 (Change or Cancellation of Service)

HIS, under agreement with the user, may change the contents of this service without informing users in advance, and HIS will bear no responsibility for any inconvenience or damage that arises. HIS can suspend or cancel service within a minimum 7-day notice period. The suspension or cancellation of service is to be announced on the “H.I.S. Hokkaido Hotels” website, and after this procedure, if service is suspended or cancelled, HIS will assume responsibility for any damages to registered users.

ARTICLE 17 (Law and Jurisdiction of Agreement)

“H.I.S. Hokkaido Hotels” is accessible from any place in the world. However, this agreement will be based and interpreted under Japanese law. If a dispute arises in terms of the use of this service, the first jurisdictional court will be in a Tokyo District Court. Furthermore, if a dispute arises in terms of international use, the regulations in the region of the country where the service was used must be obeyed.
